California State Senate Bill 9 allows for ministerial review of the construction of additional housing units and/or urban lot splits. An SB9 housing development only involves the creation of additional housing units and does not include any subdivision (lot split) of property. See also: SB 9 Lot Split Permit page.
Steps in the Process
The Planning Section of the Planning and Building Department processes SB9 housing development. In reviewing and processing your SB9 application, the assigned planner will generally complete the following steps:
1. SB 9 Pre-Application Review Process
Prior to issuance of a building permit, staff will review project compliance with SB 9 criteria and identify any environmental and site planning issues applicable to the proposed housing development (e.g., tree permit, grading permit, or necessary alterations of existing structures to comply with setbacks).Pre-application meetings are subject to a $400 fee (which can be credited towards fees for an associated subsequent formal application filed within 6 months of the pre-application) and may be requested online through Accela Citizen Access (ACA) under the Planning Pre-application option: Apply Now
2. Application Submittal
The applicant will need to email us the completed required forms and affidavits.
3. Application Review
The planner reviews your project to determine whether your application is complete. During this stage, the planner determines whether your project conforms with SB 9 criteria, the County’s General Plan, Zoning Ordinance, and other applicable regulations.
4. Environmental Review
SB 9 housing development is exempt from the California Environmental Quality Act.
5. Determination
A determination on whether the application meets SB 9 criteria is made at a staff level. The decision on SB 9 housing developments not appealable. After staff has made the determination that unit(s) is/are eligible as SB 9 housing development, applicant may submit for building permit to County Building Department, for SB 9 related construction or alteration of structures.
