Compliance and Reporting

The San Mateo County Department of Housing requires organizations receiving County funding to comply with applicable federal, state, and local program requirements. This page provides guidance and resources to assist partners in meeting program compliance and reporting obligations.

Environmental Review

Projects receiving Department funding may require environmental review under federal regulations or the California Environmental Quality Act (CEQA). 

Environmental review must be completed before committing federal funds or beginning construction.

Labor Standards

Certain projects receiving Department funding may be subject to federal labor standards and contracting requirements. Depending on the funding source, applicants may be required to comply with Davis-Bacon prevailing wage requirements, Section 3, and Minority Business Enterprise (MBE) / Women Business Enterprise (WBE) requirements. Applicants should review the applicable requirements before construction begins and throughout project implementation. <This needs a link to those pages>

Income Eligibility and Affordability Requirements

Affordable housing projects receiving Department funding must comply with applicable income eligibility and affordability requirements. Applicants should use the current income limits, maximum affordable rent payments, and utility allowance schedules when preparing project applications and administering assisted units.

Reporting Requirements

Organizations receiving Department funding are responsible for complying with the terms of their funding agreements and ongoing compliance monitoring requirements. Depending on the funding source, project type, and loan documents, recipients may be required to submit financial, operational, occupancy, and other reports to demonstrate continued compliance with Department requirements. Specific reporting and monitoring requirements are established as part of the funding agreement and regulatory documents.

The underwriting guidelines require borrowers to comply with:

  • the Loan Agreement
  • the Regulatory Agreement
  • Compliance Monitoring requirements
  • ongoing affordability restrictions
  • annual residual receipts and financial obligations
  • tenant income and rent restrictions (as applicable)
  • asset management requirements
  • other program-specific requirements established in the loan documents.
