    Officer Involved Fatal Shooting Of Roger Allen On April 7, 2021

    The San Mateo County District Attorney’s Office has completed its investigation into the fatal shooting of Roger Corneilous Allen by Officer Cameron Newton on April 7, 2021 in Daly City and has determined that the use of force was legally justified and no criminal charges will be filed. Mr. Allen was shot during a confrontation with Daly City Police Lieutenant Michael Brennan and Officers Newton and Nicholas McCarthy in front of 750 Niantic Avenue in Daly City. After a thorough investigation by Inspector Eric Suzuki and other inspectors with the San Mateo County District Attorney’s Office, District Attorney
    Stephen M. Wagstaffe has concluded that while this is a tragic incident, there is no legal basis for filing criminal charges against Officer Newton. District Attorney Wagstaffe has concluded that the use of force by Officer Newton was legally justifiable self-defense and defense of others pursuant to California Penal Code section 835a and section 196. Therefore, this case is now deemed closed by this office.
