Public Charge Updates:

The Trump Administration’s public charge rule is no longer in effect. On September 9, 2022, US Citizenship and Immigration Services (USCIS) published a final rule on the public charge inadmissibility ground. The new rule will become effective on December 23, 2022.

  • Not all immigrants face a public charge test.
  • Only a few public benefits programs are included in the public charge test.

Here is more information on which immigrants will be affected and which benefits relate to public charge under the new rule. Call our office at (650) 363-1800 or send us an email at ImmigrantServices@smcgov.org for more information.
