  • People v. Devin Kwai Lum

    People v. Devin Lum, SMC District Attorney’s Office Bureau of Investigations

    On July 6, 2021, at 9AM defendant Devin Kwai Lum appeared in San Mateo County Superior Court in front of the Honorable Judge Stephanie Garratt. Lum pled No Contest to two felony counts of voluntary manslaughter while admitting use of a firearm to commit both crimes. The families of both victims were present in the courtroom. Sentencing in the case was tentatively scheduled for October 13th at which time the court will hear impact statements from the family members before Lum is sentenced. Lum’s co-defendant, Dorian Duff-Guardado previously pled No Contest as an accessory to murder on July 8, 2020.

    At approximately 8:44 PM on February 25, 2018, Defendants Lum and Duff-Guardado drove to the Hillside Market in Broadmoor Village. A confrontation ensued in the parking lot between the defendants and other patrons, including Michael Garcia-Salem and Vanessa Guillory. Garcia-Salem approached Lum on the passenger side of the vehicle as Lum brandished a handgun. Lum raised the firearm and fired, striking both Garcia-Salem and Guillory, who was standing about 15 feet behind Garcia-Salem. Guillory and Garcia-Salem died from their injuries. A third victim, Jason Lecue, was also struck by gunfire, but suffered non-life threatening injuries and survived. The incident was captured on CCTV Surveillance for the store and seized as evidence.

    Members of the San Mateo County District Attorney’s Office Bureau of Investigations responded to the incident and assumed responsibility for the investigation. Officers with the Daly City Police Department assisted in the investigation by identifying Lum and Duff-Guardado and the surveillance footage, leading to both defendants being arrested within 24 hours.
